BURGLARY SECTION 9 (1)(a) THEFT ACT 1968 - SID
A person commits an offence who enters a building or part of a building as a trespasser with intent to SID.
Points to prove:
- enter as a trespasser a building/part of building
- with intent to
- steal or inflict GBH or commit damage
Either way - up to 14 years on indictment.
BURGLARY SECTION 9(1)(b) THEFT ACT 1968 - SI
An offence is committed by any person who having entered a building or part of a building as a trespasser commits or attempts to commit SI.
Points to prove:
- having entered as a trespasser a building/part of building
- steals or inflicts GBH on person therein
- attempts either of above
Either way offence
AGGRAVATED BURGLARY SECTION 10 THEFT ACT 1968
A person commits an offence who commits any burglary and at the time has with them their WIFE.
Points to prove:
- Commits any burglary
- has with him at the time
- any firearm or imitation firearm
- or any weapon of offence or
- any explosive
