McDonald v. Chicago
14th Amendment due process clause, 2nd amendment right the right to bear arms.
Holding: Right to keep and bear arms for self-defense applies to the states.
Establishment clause
The Establishment Clause of the First Amendment to the U.S. Constitution prohibits the government from establishing or favoring any religion. In essence, it ensures a separation of church and state
ex: cannot do school prayer
Free Exercise Clause
Individuals can practice their religions without government intervention.
ex: Muslims can go do prayers in praying halls.
Shaw v. Reno
Gerrymandering issue, Race was being used to create districts so it is fair under the Voting Rights Act
Holding: Race cannot be used as a sole benefactor of creating districts because it is Unconstitutional under the Equal Protection Law.
McCullough v. Maryland
Supremacy Clause: The US Constitution and federal laws over state laws.
Necessary and Proper Clause (elastic clause): Can assume powers that are not listed to run the country.
- Commerce Clause: fed can do whatever for commerce.
Holding: Established supremacy of the US Constitution and federal laws.
Gideon v. Wainright (1963)
He studied the law himself to council himself.
Holding: Everyone has the right to have a council. 6th Amendment right to council for ALL criminal cases.
Baker vs. Carr (1962)
Gerrymandering
14th Amendment- Equal Protection Clause
In one state the districts were not re-proportioned and the size was super unequal and it violated the 14th Amendment so the courts can review.
Holding: opens doors to courts to reviewing redistricting challenges.
