Employment At Will
Either parties can end employment at any time
Fair Labor Standards Act (FLSA)
Provides minimum wage, overtime pay, and child labor protection
Family Medical Leave Act (FMLA)
12 weeks unpaid leave per year and get to keep job and benefits. Only for companies with 50+ employees and if the employee has been there 1+ years.
For birth/adoption, serious illness, caring for family, & military deployment issues
Occupational Safety & Health Administration (OSHA)
Requires a safe workplace and prompt injury/death reporting
Income and Health Safeties:
Social security, medicare, COBRA (continues health ins. after job loss), HIPPA, ACA (Obamacare)
Employee Privacy
Monitoring is allowed if notified and on employer systems
Immigration Law
IRCA: I-9 Form required within 3 days of hire
National Labor Relations Act (NLRA)
Protects rights of employees and unions. Enforces by NLRB(board).
Rights of employees to strike and engage in collective action
Strikes
Legal if peaceful and during non-stirke periods. Economic strikes (wage increase) can be replaced immediately
ERISA
Governs retirement, pensions, & 401k regulations
TIPS
Threaten, interrogate, promise, spy
Employers can’t engage in TIPS but unions can
