Compensatory Damages
Special and General Damages. To make the victim “whole again”
Special Damages
Actual monetary loss. Hitting someone and having to pay for their hospital bill
General Damages
Non monetary harm. Equitable remedies for pain & suffering
Punitive Damages
To punish extreme and reckless behavior from wrongdoer.
Intentional Tort
Deliberate actions intended to hurt someone, and the actions does so.
Unintentional Tort
Careless actions that because harm. No bad intent.
Ex: Hitting someone with your car on accident
Strict Liability Torts
Liabilities without direct fault. No bad intent
Ex: Defective products, abnormally dangerous activities
Assault
The THREAT of harm.
intention, but no actual harm
Battery
The ACTUAL harmful action
Defamation
Libel (written) and Slander (oral)
Misappropriation of Likeness
Someone using your name without being paid or getting permission
Fraudulent Misrepresentation
Telling customers the cheese is 100% form Italy when it’s really not
Wrongful Interference
Like Verizon telling AT&T customers that their network causes cancer
Trespass to land
Unauthorized entry onto another’s land
Trespass to personal property
Interfering with someone’s personal items.
Like professor taking the girl’s briefcase
Conversion
Taking & using another’s property
Negligence
When someone fails to exercise reasonable care, resulting in harm or injury to another
Good Samaritan Law
Protects people & volunteers from liability.
Like if you break into your neighbor’s home to save him because you think it’s burning, but it actually isn’t, you’re protected
Tort
Civil wrong that causes harm/injury to another, for which the law requires a remedy
False imprisonment
Retaining someone without justification
Intentional infliction of emotional distress
Extreme conduct that causes severe emotional harm
