Consensus theory?
Moral values of majoritary population are reflected and enforced by codified law
Values determine interest
Strain theory?
Crime = something unusual occurs within the institutions that uphold society - this results in strains that affect behaviour
Conflict theory?
Law represents the values of the groups that create and enforce it, not the majoritary beliefs
Interests determine values

Social solidarity - population working together to achieve common goals
Anomie: normelessness that results from rapid change when social solidarity or cohesion is reduced - leads to breakdown in society
criminal law is nessesary to avoid this state
Limits: Was wrong in viewing pre-modern societies as relatively crime free
Merton? Gap between aspirations and means?
Applied durkheim’s anomie to american condition
Crime is a result of the gap between culturally instated goals and legitimate means available to achieve those goals (strain results in innovation - crime)
Offers insight into unethical behaviour of individuals, gangs and corporations
From normlessness to relative deprivation: specific individuals committed to the goal of wealth w/o the means to attain it
limit: forgets women (eye roll - what’s fukin new)
Richard Cloward? Illegitimate oppertunity structures?
Participation in adaptive strategy is only accessible through certain means - people under strain cannot become any kind of criminal they choose, they are limited by the oppertunities available to them
Success means different things to different people
Three subcultures of juvis undergoing strain:
Criminal: profir oriented crimes
Conflict: gang violence
Retreatist: drugs, substance abuse
White collar crime? Merton?
Weak restraints on means to achieve monetary success, and the inability to watchdog corporations - increase likelihood of opportunistic corp crime.
Institutional balance of power leaning towards economic institutions = more crime
Society needs to pay more attention to these crimes
