Duty to Act
Protects a person who is not being paid for services from liability for acts performed in good faith. Unless it constitutes gross negligence
Good Samaritan law
Before emergency care is provided patient must be informed of Care provided and associated risks and consequences this is ______ consent
Informed Consent
Type of consent obtained from every conscious adult who has capacity to make rational decisions. Verbal and non-verbal (head nodding)
Expressed consent
Also known as Emergency Doctrine occurs when you assume that a patient who is unresponsive or unable to make rational decisions would consent to emergency care if they were able.
Implied consent
Consent to treat a minor must be obtained from a parent or legal guardian or authorized care giver. Under 18
Minor consent
Applied when dealing with mentally incompetent adults or someone who is in law enforcement custody or they are incarcerated
Involuntary Consent
Legal document that pre-determines and explains how medical decisions are to be made if they can no longer make decisions themselves
Advanced Directive
legal document used to dictate future health care decisions only when they become unable to make decisions themselves. Determines type of care person would want to receive
Living Will
legal document where a person is named proxy/agent to make all health care decisions if the person is unable to do so on their own.
Durable Power of Attorney
Most encountered advanced directive.
Standardized form typically signed by patient and physician. Can not be acted upon unless the patient is in cardiac arrest. Must be presented at the time of arrival
DNR
Serious or terminal illness who are not suspected to live longer than one year. Allows patient to choose and express level of treatment
POLST Physician Orders for Life Sustaining Treatment
Wrongful act. Injury or damage
Tort
A tort in which there is no intent to do any harm but a breach in duty to Act occured
Negligence
Act considered to be negligent simply because it is in violation of a statute or regulation such as written EMS protocols or approved scope of practice
Negligence per se
Deviation from standard of care

Simple negligence
Willfully, wanton or extremely reckless patient care, well beyond being negligent or careless
Gross Neligence
It must be determined that the injuries suffered by patient were the direct result of EMTs negligence. This is referred to as
