What is the Writ of Habeas Corpus?
It is the accused’s opportunity to tell a judge about the arrest; must be held within 24hrs.
What does Reasonable and Probable Grounds mean?
It is the concrete reasons that police must have before searching a person or obtaining a search warrant to look for evidence.
What does Search mean?
It is to look for evidence that is related to a charge.
What is an Appearance Notice?
It is legally detaining a person and charging him or her with a Criminal Charge.
What is an Arrest?
It is a document that details the offence the accused is charged with and the court date the accused must attend.
What is a Citizen’s Arrest?
It is an arrest made by a regular citizen after he or she witnessed a criminal act or believed that a suspect had just committed one.
What is Detained?
It is to be kept in custody or temporarily confined.
What is Disclosure?
It is the process of providing the defence with the evidence in possession and control of the Crown.
What is a Search Warrant?
It is a document giving police the right to search a person’s home.
What is a Plea Negotiation?
It is the process of encouraging an accused to plead guilty to a lesser charge in hope of receiving a lighter sentence.
What is being in Custody?
It is to deprive a person of his or her liberty in order to lay a charge, preserve evidence, or prevent the person from committing another offence.
What is a Bail Hearing?
It is a judicial hearing to determine whether a person who has been arrested should be detained in jail or released into the community pending his or her trial.
What is an Accused person?
It is the person who is charged with a Criminal Offence.
