Who does criminal law apply to
Everyone but young people should be treated different because may have no men’s rea
Juvenile delinquents act (1908)
Treated young offenders as misguided and aimed to rehabilitate them through training schools
Youth offenders act
Recognized youth aged 12–18 as accountable, but gave lighter penalties than adults and focused on rehabilitation.
Incapacity of children
Means children under 12 are not responsible for crimes because they don’t know consequences. Instead it’s dealt with parents and police may remove kid from home.
Legal rights of youth people
Protects young people who may not know rights through fear. Right to lawyer, adult when questioning. Same rights for arrest.
Identities
Youths identity doesn’t need to be published in court document or media.
Youth criminal justice system
For non-violent crimes, police can warn the youth, involve parents, or use community programs. These require the youth’s agreement, responsibility, and evidence.
