what is the small claims court
- claims up to £10,000 and personal injury up to £1000
- informal and heard by a district judge
- lawters are discouraged and there is less legal argument
- hearings only2-3 hours and have a limited number of witnesses
what is the fast track
claims between £10,000 and £25,000
have a timetable for disclosure of documents and witness statements
trial date in 30 weeks,with a simple procedure for speed.
limit the expert witnesses and the hearing is max 1 day in court
what is the intermediate track
-new introduced in 2023
- claims £25,000 an £100,000
-for monatary relief only, not injuctions or specifiic performance
- four bands of complexity that cases can be asigned too = wuick and cheaper
what does the intermediate track hope to do
simplify the system and to deal with delays quicker and ensures greater acces to justice
what is the multi track
claims over £25,000 or those over £100,000
if over £100,00 they are heard in high court
complex cases may have a case managment conference and given a strict timetable of document disclosures
trial dates can be reffered
what is the county court
- can try most civil claims up to £100,000 , over 300 in England and wales
-personal injury up to £50,000 - deal with negligence claims and other tort bases claims
-debt claims and consumer disputes - housing claims and bankruptcy issues
- claims heard in open court , judge decides whos liable
what is the high court
- heard in high court by single high court judge
- split into three divisions 1) kings bench 2) chancery 3) family division
- judge decides who is liable and if there i any compensation or remedy
-for cases over £100,00 or over £50,000 if complicated
what is the queens division
- largest of the divisions
- hears cases not suitable for county court eg high profile cases eg amber heard and johnny depp
- claims over £100,000
what is the chancery
sees disputed relating to buisness , property or land , disuputed over trusr or partnership matters
what is the family division
often heard in private for sensiitve matters
welfare of children - “ ward of the court” or complicated family incidents
