Question 3

Occupation Order

Answer 3

Any person in a domestic relationship may apply for this.

Means they can personally and exclusively occupy the house

Do not apply to rented properties

Question 4

Tenancy Orders

Any person in a domestic relationship may apply for this.

Can apply for the tenancy of the dwelling house if the other person is the sole tenant or in joint tenancy with the applicant

Question 5

Ancillary Furniture Order

A person applying for an occupation or tenancy order may also apply for this.

Gives applicant exclusive possession and use of any or all furniture and household appliances.

Temporary for 3 months then final for 6 months.

Furniture Order

May be applied for if person has applied for protection order but not occupation or tenancy order.

Same effect as ancillary furniture order.

Protection Order

Order to protect a person from domestic violence.

Can be made with or without notice. The order is temporary for 3 months before becoming final. In that time person can appeal.

Protection Order Standard Conditions

Not to offer violence
Must not harm or threaten the protected person or damage or threaten to damage their property or encourage another person to do these things.

Not to contact
When living together, can be suspended with protected person’s consent.
Otherwise when not living together, person must not make any form of contact(txt, email, letter, card, phone), be near or follow them, or enter property occupied by the protected person without consent

Weapons
Must not possess or have in their control any firearm. Must surrender firearms license and firearms within 24hrs of being served
