1. A wrong must have been carried out by an ultimate wrongdoer (breach/tort)
2. There must be a need for an order to enable action to be brought against the ultimate wrongdoer
3. The person against whom the order is sought must be
   a) MORE than a mere witness
   b) Be able to provide the information necessary for the ultimate wrongdoer to be sued
4. The court must be necessary AND proportionate
5. Costs
