Where CDEM considers the threat of or where there is an emergency state is in force a warrant may be issued to Police. The overall purpose of this is to;
obtain information required urgently to prevent or limit the extent of the emergency
CDEM 78 Power of entry is to obtain information. Note not a dwelling house

Information seized during warrant for CDEM must be
Given to the Director, a Controller, or a person authorised by a Civil Defence Emergency Management Group
if no longer required for the purpose for which it was seized, return it to the person from whom it was seized

Direct any person to stop any activity that may cause or substantially contribute to an emergency, or request any person either verbally or in writing to take any action to prevent or limit the extent of the emergency

Examine, mark, seize, sample, secure, disinfect, or destroy any property, animal, or other thing in order to prevent or limit the extent of the emergency
The CDEM Act confers certain powers on the Police and other authorised persons during a state of emergency. S93 requires a person exercising a power conferred on him
(a) have with him or her, and produce if requested to do so, evidence of his or her identity; and
(b) if requested to do so, produce evidence of or give a general explanation of the authority under which he or she is acting and the power or powers he or she is exercising.
Offences against CDEM are
Intentionally failing to comply with a requirement in a civil defence emergency management plan
Threatens, assaults, or intentionally obstructs or hinders any person in that person’s exercise or performance of a function, power, or duty under this Act
Penalties for committing an offence against CDEM are
3 Months imprisonment, $5000 fine or both
If a body corporate $50,000
