What is Advocacy Structure for the exam

A
  1. Introduce yourself on behalf of your client
  2. Advise what the application is for
  3. Check the judge has bundle (remember judge will not have privileged information)
  4. Provide a summary of facts
  5. Test
  6. Sign post what your submissions are
  7. Submissions in details
  8. Conclude with a summary of your submissions and a request if necessary
    Tip
    When creating your submissions:
    Law+ Facts = why I’m rights
    Consider: breach of contracts, Negligence, criminal law

What is the client interview structure you should follow?

A

1.introduce yourself as the solicitor assisting with matter
2. Is the client happy for you to call them by their first name?
3. Check client details
4. Advise before interview starts you will be taking notes, and this you will still be listening, you just want to ensure you have all the information so you can provide the right advice
5. Set Agenda- discuss clients problem and any questions, provide preliminary advice to client, then any further follow up questions
6. Open questions…
I understand your here today because of ….. how can I assist with this?
Please tell me more about….
7. Closed questions about issue
8.provide preliminary legal advice
9. step out next steps, inc practical,legal and letter of advice
