Health & Safety at Work Act 1974

A

Duty of care of employer to ensure health, safety, and welfare.
Policed by Health and Safety Executive (HSE) – criminal law.
Must report injuries and dangerous occurrences and regularly review risk assessments.
Hazard – something with potential to cause harm.
Risk – likelihood of harm being realised.

Risk Assessment

A

A legal requirement if there is more than 5 staff members.
I – Identify hazards and people at risk.
E – Evaluate the risk.
R – Record findings.
R – Review regularly.
A – Advise all affected the outcome and methods to minimise risk.

The Fire Safety Act 2021

A

Following the Hackitt Review, reforms the Fire Safety Order 2005.
* Regular inspections of lifts to be reported to fire service.
* Evacuation plans regularly updated and for disabled people.
* Ensuring residents are provided with an evacuation plan.
* Responsible person appointed who ensures risk is reduced.
* Ensure flat doors comply where external walls unsafe cladding.

Two Stair Core Information?

A

Michael Gove announced in July that all new residential blocks over 18m or 7 storeys will need to have two stair cores.
Amendment made to Document B – was previously buildings over 30m. Mandatory from December 2023 – applications prior are still eligible.

Asbestos (Control of Asbestos Regulations 2012

A
  • Insulating material - no risk if left undisturbed.
  • 3 types (banned): Brown (1985), Blue (1985) and White (1999).
    Control of Asbestos Regulations 2012 – criminal offence
    Duty holder = owner or tenant with repairing lease – must undertake risk assessment, management plan must be in place.
    2 types of survey:
    1. Management survey – locate and advise on management
    2. Demolition survey – samples taken and analysed
    Architects must confirm new buildings do not contain asbestos
    Asbestos register must be readily available

RAAC - Reinforced Autoclaved Aerated Concrete

A

Light form of pre-cast steel reinforced concrete, no coarse aggregate.
Used in post war Britain 1950s-1980s, roof decks, walls, and floor mainly in public sector buildings e.g., schools. Deleterious material.
Deflection of RAAC is 10x equivalent concrete plank under same loading conditions – pooling of water on flat roofs increase load – water ingress.
Lifespan of 30 years, high potential for sudden collapse – urgent!
Planks are typically 350mm-750mm in width and found to span up to 6m. Mainly used for the construction of FLAT ROOFS.
Regular inspection should be undertaken, records kept and any changes in behaviour can be readily assessed.

Deleterious and Hazardous Materials

A

Deleterious – degrade with age, brown staining on concrete, due to high alumina cement, woodwool shuttering, calcium chloride.
Hazardous material – harmful – asbestos, lead piping, radon gas. Recommend specialist reports, check asbestos report/register.

RICS Professional Standard – Japanese Knotweed and residential property 2022

A

to help valuers decide appropriate management approach, allowing to spread is a criminal offence as per the Wildlife and Countryside Act 1981. Maximum fine of £5,000 or prison sentence of up to 6 months.
Other invasive plants: Hogweed and Himalayan Balsam.
Williams v Network Rail 2018 – Defendant liable for treating invasive plant and damages but not reduced property value.

Building Safety Act 2022

A

Legislation to ensure residents have a stronger voice in ensuring safety in buildings. Higher risk buildings are 18m or 7+ storeys.
There is now a requirement (as of July 2023) for these buildings to have two staircases.

Inspection of a PBSA development site, Canterbury

A

Accounts valuation, desktop risk assessment, wear correct PPE, arrange access, and complete client’s risk assessment questionnaire. I follow CBRE’s lone working policy which includes, ensuring diary up to date, notifying supervisor when arriving and leaving safely.
