Defences for children

A

s. 21 CA 1961 – No person shall be convicted of an offence by reason of any act done or omitted by him when under the age of 10 years. (absolute defence)
s. 22 CA 1961 – No person shall be convicted of an offence by reason of any act done or omitted by him when of the age of 10 but under age of 14, unless he knew either that the act or omission was wrong or that it was contrary to law. (Must know act was wrong and illegal).

Proof of age: R v Forrest and Forrest

A

The best evidence possible in the circumstances should be adduced by the prosecution in proof of the victims age. E.g birth certificate and statement from person who attended birth or mother.
