What is a juvenile?
Child under 18 years old

Child over 7 years but under 18 who commits a act that would be a crime if committed by an adult.
JO
13,14,15 year old that is charged with committing a violent or serious felony. Cases are heard in the youth part of the Supreme Court Or county court.
AO
16 and 17 year charged with felony offenses. Cases are heard in youth part of the Supreme Court or county court.
Juvenile appearance tickets may not be issued for what class felonies?
Class A,B,C or D
Can appearance tickets be issued to Juvenile Offenders?
No because all crimes are at least a Class C felony
Runaway
Person under the age of 18 who has run away from home without just cause

Youth part of Supreme Court or County Court. If it’s a non violent felony it will be heard in family court.
What cases cannot be sealed for juveniles even after being crime free for 10 years?
Sex offenses, violent felonies and other serious felonies
Where are Juvenile Offender cases heard?
Youth part of the Supreme court or County Court. **cases may be transferred to the family court **
What does a member do for a juvenile under 16 yrs of age that commits a violation or traffic infraction?
Taken into custody and turned over to parents
If a 16 year old commits a vtl misdemeanor how will they be processed? Is it the same for a 17 or 15?
Processed in the appropriate local criminal court. Fingerprints and photos.
Approval is needed from who to detain a juvenile in jail, lockup, holding cell or other place for adults?

It what situations may OCFS approve placement of juveniles in holding cells? Placement in cells for any other reason shall be approved by who?
- Held for processing or release
- Held awaiting transfer to juvenile facility

If a juvenile has committed an act of juvenile delinquency and the member is unable to contact a parent or guardian where shall the juvenile be taken?
Family court and if not in session await at juvenile detention facility until court is in session
When a member takes an alleged PINS into custody what shall the member do:
- Notify a supervisor
- Run a file check
- Notify parent or legal guardian
- Release person to custody of parents or person responsible to produce the PINS in family court
- under special circumstances member may take the juvenile to a social program or courts for questioning or approved runaway program
If the parent of a juvenile objects to the questioning or request an attorney, can questioning continue?

What needs to be taken into account when questioning a juvenile and the parents cannot be notified.
- Every effort to notify parent/guardian was exhausted. Efforts need to be documented in department incident report and memo book
- Determine the necessity for questioning the juvenile at that time
- Taking the juveniles age, apparent intelligence and the juveniles ability to understand the Miranda warnings into account
