Criminal Law
Regulates behaviour between an individual and the community.
Summary Offences
Minor offences heard by a magistrate.
Indictable Offences
Serious offences that are heard before a judge and a jury.
Defendant
A person charged with a criminal offence in a court.
Accused
The term used to refer to a defendant in the county or Supreme Court.
Civil Law
Regulates behaviour between one individual or another individual.
Plaintiff
Is the person or organisation who has brought the case to court.
Defendant
Is the person or organisation who is disputing the claims made by the plaintiff.
Balance Probabilities
- The court will determine whether a persons rights have been infringed.
The Principles of our legal system
- All individuals are equal before the law
- Individuals have the right to a fair hearing
- The judiciary ( the court system ) is independent and impartial.
- Individuals have the right to a reasonable appeal
What are laws?
laws set out our basic rights and responsibilities. Rules can be either legal rules or non-legal rules.
Non- legal rules
Apply to a group or organisation, but not to society as a whole. The members of the group agree to be bound by the rules, which do not have the force of law.
Legal Rules
Apply to all members of society and include criminal and civil law.
Criminal Law
Deals with crimes such as murder, theft and culpable driving.
