Electronic Prescribing of Controlled Substances
All prescribers are required to transmit controlled substances electronically EXCEPT: veterinarians and medical residents
Sanctions
If you violate any of the regulations the board must act upon that and usually done by a hearing where the board will provide legal evidence against the practicioner and the practitioner can respond. This is not a legal hearing but it is public domain
- you can have legal representation
- if you disagree with hearing you can appeal a sanctions (Judge can only determine if the board follows the rules not if the sanction was fair)
Electronic Prescribing of Controlled Substances: Exemptions
1.The prescriber cannot transmit electronically due to technology failure
2.The prescriber issues a prescription to be filled outside of Indiana/ and if its being written in a different state and being filled in Indiana (from somewhere else)
3.The prescriber must issue in another format due to legal requirements or a public health emergency
4.The prescriber has received a waiver from the board
5.The board has determined that an electronic prescription would cause delay and adversely impact a patient
6.The prescriber determines that it would be impractical for the patient to obtain an electronic prescription and that delay would adversely impact a patient
Telehealth who can prescribe
Many other practitioners can provide telehealth care, including pharmacists but the list below is the only practitioners that can Prescribe when using telehealth:
Physician
Physician assistant
Advanced practice registered nurse
Optometrist
Podiatrist
Dentist
Veterinarian
Issuing prescription Via telehealth
if its the first time seeing the patient the prescription is valid if it meets the standard of care for treating the patient, its in the prescribers scope of practice, the prescription is not abortion inducing drug, If its for a medical device the prescriber is using sufficient technology to allow for an informed diagnosis and plan
Issuing controlled substance via telehealth requirments
- must have Inidana valid CSR
- must follow federal law
- issued for legitimate medical purpose
- must be a zoom type call
- prescriber complies with INSPECT protocol
- all other federal and state laws are followed
Cannot prescribe opiod unless its for opioid use dependence
Limitations for prescribing opioids via telehealth
A prescription for an opioid may not be written for greater than 7 days:(some exemptions)
-If the prescription is for an adult being prescribed an opioid for the first time by the prescriber
-If the prescription is for a child less than 18 years old
-If the prescription is for an animal for the first time by the veterinarian
Exemptions to 7 day limit prescription for opioids via telehealth
The 7-day limitation does NOT apply if the prescriber is issuing the prescription for:
A.Cancer
B.Palliative care
C.Medication-assisted treatment for a substance use disorder
D.A condition that is exempted by the medical licensing board
Or if, in the prescriber’s professional judgement, a patient requires more than the prescription limitations listed on the previous slide
