Define compensatory damages
are damages that aim to compensate the plaintiff who has suffered injury or loss to the extent that money is able to do so as a result of the defendant’s wrongful actions.
define general damages
are those damages which can only be estimated by the court for such things such as pain, suffering, inconvenience, loss of enjoyment of life and disability.
define specific damages
are damages that can be readily measured and stated as exact amounts; for example hospital and medical bills, loss of income and damage to property.
define exemplary damages
these are damages awarded against a defendant in order to make an example of the person and thus deter others from committing the same tort.
define nominal damages
these are damages awarded to a plaintiff who has suffered no real monetary loss, although there has been some important rights infringed.
What is the difference between a mandatory and a restrictive injunction? Give an example of each type of injunction
mandatory injunctions—–are when a court order requires the defendant to do something such a pulling down a wall that has been built unlawfully. Restrictive injunction requires the defendant to refrain from doing something such as defamatory material.
