How do you ensure that you comply with bribery legislation?
*Not offer or accept, directly or indirectly, anything that could constitute a bribe
Ensure that they have adequate knowledge of bribery and corruption to be able to comply with the requirements of this professional statement
Report any activity they are aware of that breaches applicable anti-bribery and corruption laws to the relevant authorities
How do you ensure you comply with money laundering regulations?
Rules of Conduct, which mandate that members and firms must not facilitate financial crime, including money laundering, and require robust processes to prevent it, including identifying PEPs, PSCs, and potential sanctions breaches.
How do you ensure you comply with your firm’s bribery and gifts policy?
Act honestly and with integrity at all times and safeguard the Council’s resources for which I am responsible for.
Tell me about an instance of when you have been offered a gift or hospitality by a client.
I was offered a box of chocolate at Christmas, small seasonal offers of gratitude can be accepted and do not need to be declared as per KMBC’s policies. Higher value items would need to be formally declared.
Tell me about what you would do if you felt that an instruction was outside your scope of experience or knowledge.
If the instruction was outside of my competence and I didn’t the skills, knowledge and experience to carry out the works I would be honest with the client and decline the instruction and either refer them to another professional.
Tell me about an instance of when you have handled client’s money.
As a council we do not handle clients money however if I did I would you must ensure client money is kept separate from your firm’s funds, held in a dedicated client account, and that you maintain accurate records and comply with RICS regulations
How would you keep client’s money securely and safely held?
*Firms must preserve the security of clients’ money entrusted
to its care in the course of its practice or business
*Money must be clearly linked to a client in the event of
insolvency, misappropriation death of a sole practitioner or
transfer of money to another organization
Money held in separate client accounts, adequate control by
competent staff
Tell me about how you would handle a client complaint.
*A firm must operate a Complaints Handling Procedure (CHP)
*it must include a redress system (e.g. CEDR) Centre for Effective Dispute Resolution (CEDR) specialises in mediation and alternative dispute resolution (ADR)

Tell me about your understanding of your firm’s process for escalating a complaint to Alternative Dispute Resolution (ADR).
Tell me about a conflict of interest check you have carried out.
As part of a project that I was managing one of the employees of the contractor’s tendering for the works is a parent at my child’s school. I notified my Head of Services of this as the employee was not directly involved in the project this would not affect my impartiality.
If you identified a potential or actual conflict of interest how could you handle this?
it would depend on the COI if the COI meant that I could not be impartial I would notify the client of the COI and decline the work opportunity. However if the client was content for me to continue to act this would need to be confirmed in writing
