Mental disorder
Abnormal state of mind whether continuous or intermittent - delusions, disorders of mood or perception or volition or cognition
Serious danger to person or others
Diminishes capacity of that person to take care of self
38 - assistance when May need assessment
Believe mentally disordered so request DAO
DAO must investigate and satisfy self concern is genuine and RGB suffering from mental disorder and decides needs exam urgently
If not urgent, arrange mental health th practice to examine with a view of cert 8B(4)(b)
Then apply under 8A for assessment
Assessment under 9
If urgent, try get prac to come with same view of cert
Seek police assistance under 41 if can’t come and try get to go willingly
Then same 8A and 9 as above
39 outpatient and inpatient leave
Subject to assessment at hospital
Community treatment order
Impatient order but on leave
Can get advice or assistance from a DAO
On this request shall
Investigate
Inform responsible clinician of grounds of concern
Give appropriate advice/assistance
40 - assistance in taking or returning for assessment or treatment
If required to attend place for

Exam under 9, 11 or 13 or 14A(3)(b) or (c) or 76(1A) and refusing
And
(b)
Subject to community treatment order and refusing to attend
And
(c)
Inpatient order and absent without leave or expired

41 - Police Assistance
Anything DAO under 38(4)(b) or (d) or 40(2)
Constable assist
Can enter

40(2)(a) take to where required to attend then as above for whichever 9/11/13 etc

Responsibilities, transportation, use of force
DAO official in charge. Police assistance only if powers and specific police expertise required
Assessments should be at least restrictive environment
Intoxication level should not delay any mental health assessment
Arrest provisions
30 - protects from criminal responsibility if arrest in good faith and reasonable/probable grounds to be named person in warrant
31- all stat powers of arrest without warrant for all constables
34- powers to assist a constable in arrest anyone asked to do so
