No, the main contractor or any person having control of the site can be served
What happens if a s.60 is ignored?
Without a reasonable excuse, a £5,000 fine and £50 per day thereafter.
What else could happen to stop noise on a site?
An injunction to ‘stop work’ could be issued
Under COPA can you appeal?
Yes, an appeal suspends notice until a hearing, the time for appeal is 21 days
How long does a LA have to issue a prior consent notice under s.60
LA must issue or refuse prior consent notice within 28 days
