A defendant (at least 18 at commission of crime) MUST be sentenced to life imprisonment without parole upon conviction for the crime of:
1. terrorism (PL 490.25) where offense committed is a class A-l felony
2. criminal possession of a chemical or biological weapon first degree (PL 490.45)
3. criminal use of a chemical or biological weapon first degree (PL 490.55)
(These 3 cases do not preclude sentence of death if deft, is convicted of murder first degree)
Also, 4. murder second degree (PL 125.25, sub 5)
5. aggravated murder (PL 125.26)
6. Generally, if defendant is convicted as a violent felony offender or second felony offender, court must impose a determinate sentence, including a period of post release.
Generally, the court must impose a determinate sentence of imprisonment (and a period of post¬ release supervision) where the person is sentenced as:
1. violent felony offender (PL 70.02)
2. second violent felony offender (PL 70.04)
3. second felony offender on conviction for a violent felony offense (PL 70.06)
