‘Development’ definition
Building/engineering/mining in/on/under land + any material change in use
Types of development
- Operational development (planning permission)
- Change in use (class order)
What is NOT a development?
- internal non-structural change
- same class use
- doesn’t change external appearnace
When is planning permission automatically granted under General Permitted Development Order (GDPO)?
- smaller extensions
- CCTV camera
- sunroom/extend kitchen
What is a ‘completion notice’
Local Authority require works completed in a specific time period if they think its wont be done in reasonable time

Disapply GDPO - disapply automatic planning permission
Breach of planning permission - options for local authority
- enforcement notice
- stop notice
3.breach of condition notice
- injunction
Enforcement notice?
serve in breach of planning permission
specify:
- breach
- steps to remedy
- timescale
- right to appeal
effective after 28 days
Stop notice?
active inbetween the 28 days before enforcement notice (serve enforcement notice first)
‘Breach of condition’ notice?
breach of condition added to planning permission
Injunction?
Serve on occupier
LPA prove: necessary + needed
If turning into a home - 4 years
All else - 10 years to act

Concerned with the health
and safety aspects of buildings
If no Building Regulations Consent - when can you bring proceedings?
Wales - 2 years
England - no limit
