Under the Health Insurance Portability and Accountability Act (HIPAA), certain health information, known as protected health information (PHI), is safeguarded to protect patient privacy. Patients have rights to access their medical records and know who has accessed them within the last 6 years.

The Privacy Rule permits disclosures to public health authorities for disease prevention or control without individual authorization.
If an insurer needs to share information regarding potential HIV/AIDS infection, they must provide notice to the applicant regarding the collection and use of personal information. The notice should include the applicant’s right to refuse permission for sharing this information.
Disclosure authorization forms must be written in plain language and approved by the Department of Insurance
