Residuary gifts

what happens if a residuary gift to a named B fails?

Answer 1

the residue passes on intestacy unless the Will made alternative provision

if the residue was given to multiple Bs, only the failed share will pass on intestacy (i.e. partial intestacy occurs)

Question 2

what happens if a residuary gift to a class of Bs fails?

Answer 2

the gift does not lapse (i.e. it is not subject to intestacy - unless all of the class predeceased T).

The surviving members of the class take the gift.
