A

S&SAA 2012 s.266 - Power of Closure

Police may close licenced premises under s.266 in the following:

  • Riot or RGTB
  • Fighting/serious disorder or RGTB
  • Significant threat to public safety
  • Conduct on premises is substantial nuisance
  • RGTB offence committed with max penalty of 5 years & significant risk of further offences

Cannot close for more than 24 hours following end of day which order was made

Must seek permission from substantive sergeant

A

Policing Act 2008 Section 38 gives power to detain and find shelter for any person they find intoxicated in P/P or trespassing

A constable may Take a person whom they find intoxicated in:

  • P/P
  • Trespassing

Who is:

  • Incapable of protecting themselves
  • Likely to cause physical harm
  • Likely to cause significant damage
  • To intoxicated persons home unless unreasonable
  • Temporary Shelter unless unreasonable
  • Police station up to 12 hours or until person not intoxicated
