Q

READING: WARDLOW V ILLINOIS

A

Wardlow ran from cops IN HIGH CRIME AREA and they went after him, detained him and did a frisk because they ostensibly wanted to protect themselevs. found weapon.

was this evidence admissible in court? was there reasonable suspicion to do so?

reasonable suspicion necessary for stopping and frisking for safety. there needs to be a BRIGHT LINE for determining whether or not something satisfies reasonable suspicion standard. in this case, the man being in a high crime neighborhood coupled with his running away was fine. you have to examine the case considering “THE TOTALITY OF THE CIRCUMSTANCES”. so his flight is one factor among many cops could give for having suspicion he was criming.

YET, HIT RATES CAN BE EXTREMEMLY LOW: AVERAGE OF .5% OF STOPS IN NY YIELD A GUN.
