What is a section 278 agreement?
Allows developers to enter into an agreement with the local council to make permanent alterations or improvements to the highway.
In your CPD you said you read an article about letter of intent - what did it say?
It detailed the risks of using letters of intent as well as how it can have a liability on us as consultants. If there is no choice but to enter into a letter of intent, both parties should approach it with the assumption the main contract may never be entered into. This means that essential terms such as limits of liability, division of risk and insurances must be included.
Recent case law shows that consultants can be sued for failing to advice on the risks posed by starting the works on the back of LOI - PM (T&T) sued as client couldn’t claim LD’s
