The three (3) factors under the Code that are considered in determining undue hardship are:

A

cost;
outside sources of funding; and
health and safety requirements.

Other factors may also be relevant and the case law in this area is always evolving. Each accommodation situation must be assessed on its own set of circumstances to determine if the Service has reached the point of undue hardship.
