2 Features of the due process model

A criticism of the due process model
some guilty people may be freed on a legal technicality
how does the due process model link to left realism
LR believes zero tolerance policing creates a divide between the police and public
DPM avoids this by putting safeguards in place to protect the public from miscarriages of justice
how does the due process model link to the label theory
police are likely to follow stereotypes, e.g. arrest people who seem like the stereotypical criminal.
DPM protects against this through the legaslitive obstacle course which restricts police powers

- CJS should be an ‘efficient conveyor belt’, quickly prosecuting offenders

due to its focus on a quick process, it encourages the risk of a miscarriage of justice as the case will not be effectively looked into
how does the crime control model link to right realism
right realism believes in zero tolerance policing and punishing offenders of all crimes
CCM believes in the police having increased power, which would allow them to follow this
how does the crime control model link to functionalism
functionalism believes crime reinforces boundary maintenance, strengthening societies public perception of right and wrong
CCM makes an example of offenders, therefore strengthening the publics perception.
