Life sentence
Most serious form of punishment
Judge sets a minimum time they must be in prison before being considered for release
Indeterminate sentence
Minimum time offender must be in prison but no automatic right to release after that time
Parole decide if they can be released on license
Mandatory life sentence
Compulsory life sentence for people guilty of murder, and discretionary sentences can be given for rape - no potential for release on license
Determinate sentence
Fixed length
Most UK prisoners are serving this
Community or suspended sentence
Given prison sentence but it is served in the community
Don’t go to prison
IPP
Imprisonment for public protection
Detained for life
On license
Serve rest of life sentence in community but can be recalled to prison if conditions are broken
Whole life term
Will be in prison for rest of their life
Aims prison meets
Retribution - offender is given just deserts BUT prisons become overpopulated leasing to early release
Detterance - deters potential offenders and offenders from reoffending BUT high reoffending rates, only works if offenders can think rationally
Incapacitation - offenders unable to commit further offences in prison BUT doesn’t stop offenders committing crime in prison
Reparation - can’t make amends behind bars and not many prisoners have ability to earn money outside of prison under Prisoners Earnings Act 2011
Rehabilitation - prison programmes allow for changes from offenders to non offenders BUT 48% reoffend within a year
Aims community sentences meet
Retribution - all community sentences requires some form of punishment like curfews, just deserts given as punishment fits tariff point system BUT some see it as a way out of punishment
Detterance - naming and shaming aspect as well as amount of unpaid work could deter BUT still some freedoms so not as dettering
Incapacitation - requirements that go alongside community sentences and threat of being sent back to prison protects public BUT don’t lock offenders up so can still harm public
Reparation- unpaid work to repair damages and pay back community, some require restorative justice
Rehabilitation - often come with drug or alcohol, anger management or training support, studies show they are better at rehabilitating than short prison sentences BUT there usage has declined, 14% in 2007 to 7% in 2020
