(h) The State Mining Engineer must stipulate reasons why an independent study is required in the notice.
(i) A qualified engineer or other qualified professional approved by the State Mining Engineer.

- Incapacitated from performing their duties.
- Absent from the mine (other than normal commute)
- Unavailable to perform their duties.
The Principal Employer must appoint an eligible person as deputy of the Underground / Alternate Manager for that duration.

(b) A person is eligible to be appointed Deputy Underground Manager if that person is eligible to be appointed Underground Manager for the operations.

A person who holds an Underground Supervisors Certificate or equivalent may also be eligible but cannot be appointed as Deputy Underground Manager of a mine employing more than 25 persons underground for more than 4 weeks without approval by the State Mining Engineer.

(c) The Mine Manager has the management & control of the mine subject to any instructions given to the Mine Manager by or on behalf of the Principal Employer.
They must, as far as practicable
- Manage & control the operation of the mine in line with the Act.
- Ensure every person appointed to perform any duty understands the nature & scope of that duty.
- Ensure every person, other than the Principal Employer, performs all appointed duties.

(d) The Registered Manager must, within 7 days of assuming control & supervision of the mine, notify the District Inspector and acknowledge by signature in the notification of their appointment as Registered Manager.

(d) The Principal Employer must make such financial and other provisions to ensure the mine is planned, laid out, managed and worked in accordance with relevant statutory provisions. (a) Before mining operations begin, the name and address of the Principal Employer at the mine must be provided in writing to the District Inspector.

(b) The Principal Employer must make financial and other provisions as are necessary to ensure the mine is planned, laid out, managed and worked in accordance with relevant statutory provisions.
The imposition of a duty by this Act on some other person does not detract from the duties imposed on the Principal Employer.

(c) The new Principal Employer must, within 7 days after the change occurs, provide the District Inspector:
- The name and address of the new Principal Employer and each person who is a member of the group that comprises the new Principal Employer.
- The day on which the change occurred.

(d) The Principal Employer must, within 7 days, provide particulars of the change of name or address to the District Inspector.
