5 Basic Fair Housing Laws
- may not discriminate on basis of race, color, religion, sex, handicap, familial status, or national origin
- may not disclose info regarding race, religious, or ethnic composition of any neighborhood
- shall not induce panic selling
- shall not advertise indicating any type of discriminatory preference
- members who violate the code are subject to disciplinary action
Federal exemptions to fair housing
- owner-occupied two-unit dwelling
- single-family housing sold without use of licensee
- housing operated by orgs. and private clubs that limit occupancy to members
Exemptions on a single-family home
- individual doesn’t own more than 3 homes at one time
- licensee is not involved in transaction
- discriminatory advertising is not used
Megan’s Law
promotes the establishment of state registration systems to maintain residential info on every person who commits a child or sex related offense
Equal Credit Opportunity Act
prohibits discrimination in the lending process based on race, color, religion, national origin, sex, marital status, or age or the receipt or public assistance in the granting or credit
Blockbusting
aka panic selling the unlawful act of encouraging people to sell or rent their homes by claiming that the entry or prospective entry of a protected class of people into the neighborhood will have some sort of negative impact on property values
Steering
the channeling of homeseekers to particular neighborhoods or by discouraging potential buyers from considering some areas
Redlining
the practice of refusing to make mortgage loans or issue insurance policies in specific areas for reasons other than the economic qualifications of the applicants
