S. 3 CYPCPA – Child:
Child:
A person under 16 years of age.
S. 3 CYPCPA – Young Person:
Young Person:
A person 16 years of age or over, but under 18.
Risk Factors of Child Abuse:
• Socially or geographically isolated.
• Access to extended family.
• Multicultural – different cultural perspectives on raising children.
• Lack of knowledge of available services.
• Family situations where parents lack sufficient parenting
skills.
• Parent Deliberately harms the child – seeking attention by
harming the child.
Abuse Types:
(PENS) Physical Emotional Neglect Sexual
S. 27 CYPCPA – Mandatory Reporters:
If PO has reasonable grounds to suspect that a child is, was or will be at Risk of Significant Harm (ROSH), the PO is required to report it!
– Reporting is only applicable to children. Does not include
young persons.
S. 23 CYPCPA – Children / Young Person at ROSH:
A child or young person is determined at Risk of Significant Harm if:
• Child’s physical and psychological needs not met.
• Parents unable or unwilling to arrange medical care.
• Required to attend school.
• Physically or sexually abused or Ill-treated.
• Exposed to DV.
• Suffering serious psychological harm or at risk of.
• s. 25 prenatal report, no action taken to eliminate or
minimise harm.
Risk of Significant Harm (ROSH):
Safety and well being of child not threatened or compromised.
Still significant concerns.
Imminent Risk of Significant Harm (IROSH):
Safety and well being of child is at immediate significant risk.
Able to remove child immediately.
Serious Risk of Harm:
Harm to a level where there are grave concerns for the safety, welfare and well-being of a child/YP. Also as a result of cumulative impact of chronic neglect or exposure to ongoing DV. Consider: • Clothing • Hygiene • Weight/height • Extended stays from home • Stealing food • Deteriorating conditions • Indicators that child has experienced some type of abuse.
S. 43 CYPCPA – Removal of Child / Young Persons Without Warrant:
PO may remove a child / YP from a:
(1) Place of risk if reasonably suspect they are:
• At immediate risk of serious harm, and
• An AVO would not be sufficient to protect the child / YP from that risk
(2) Public place if reasonably suspect they are:
• In need of care and protection, and
• Not subject to the supervision or control of a responsible adult, and
• Living in or habitually frequenting a public place
(3) Premises if reasonably suspect they are:
• In need of care and protection, and
On any premises where:
• Prostitution or acts of child prostitution take place, or
• Production of child abuse material takes place
Are currently used in or have participated in:
• An act of child prostitution
• The production of child abuse material
– PO has the power to enter any premises or place and search for the child/YP where it is reasonably suspected the child/YP is present (includes adjacent property).
