Codified And Unentreched Constitution Flashcards
(8 cards)
Why would the UK need an entrenched and codified constitution?
Laws need more protection, parliament has too much power, outdated and undemocratic
Why do laws need more protection?
Human rights can be changed and need protection, would give more rights and protections for minorities
Why does parliament have too much power?
Concentration of power is harmful, can override laws, few safeguards against use of power
How is the constitution outdated and undemocratic?
Royal prerogative date back to medieval times, monarchy and hereditary peers still exist, HoL comes from undemocratic era
Why wouldn’t the UK need a codified and entrenched constitution?
Adaptable, parliamentary sovereignty is needed, it works well as it is
How is adaptability good?
Allowed anti terrorist measures to be introduced after 9/11, allowed 2010 coalition to be formed, can be changed without referendums or supermajorities
How is parliamentary sovereignty good?
Power isn’t broken up, legislative has supreme authority but regular power lays with executive which lets gov fulfill promises
How does the constitution work well as it is?
Royal prerogative is hardly used, HoL has faced reforms, changes would cause more issues (e.g. US constitution with harmful gum laws)
