What do you mean by consumer exploitation?
Explain the term c.e
c.e meas harming the interests of consumer in various ways. When the consumers do not get value for their money due to dishonesty on the part of traders and/or manufacturers. Consumers feel cheated. Sometimes, consumers are not even aware that they are being exploited. C.e violates the basic rights of consumers. Too greedy retailers and/or manufacturers want to earn unreasonable profits

Explain types of consumer exploitation?

1-Overcharging
it occurs when businesses or sellers set prices for goods and services that are significantly higher than their market value
2-Underweighing
it is a form of consumer exploitation where sellers intentionally provide customers with less quantity or weight of a product than they have paid for.
3-Adulteration
it is a act of adding inferior, harmful, or cheaper substances to a product, comprising it’s safety.
4-Misleading advertising
it involves making false or exaggerated claims about a product;s benefits or performance to entire consumers into buying it.
5-Not informing consumers about the adverse impact of the product
this is an another way of exploiting cosumers. This lack of trasparancey prevents consumers from making informed decisions and taking necessary precautions.
what is the need of consumer protection?
protection of consumers is necessary due to the following reasons:
1-Business is part of society.it gets materials, manpower, machinery and other resources from society. therefore, it is obliged to supply the right products at reasonable prices to the public.
2-it is a moral responsiblity of busiess to protect and promote the interests of cosumers.
3-the basic function of business is to satisfy the needs and expectations of consumers. it is through consumer satisfaction that business can earn the profits and continue operations in the long run
4-the government of india is committed to the welfare of the general public by encouraging fair trade practices
5-consumers are becoming more and more aware of their rights. Education and information through newspapers, radio and television have made people concious of their rights as consumers.
According to you, is there any need to have a consumer protection act? -justify
Yes, a Consumer Protection Act is absolutely needed to safeguard consumers from exploitation and unfair practices in the marketplace

consumer exploitation occurs largely due to the ignorance of consumers. consumers who are aware of their rights are not likely to be exploited. consumer awareness is an act of making sure the buyer or consumer is aware of the information abt the products, services, and consumers rights. c.a is important so that buyer can take the right decision and make the right choice.

why was the consumer protection act reframed in 2019?
several laws had been passed to protect consumers. however this act, 1986 was silent regarding e-commerce transcations.
the definition ‘consumer’ under the 2019 act includes all those who buys any goods for consideration or avails /hires any service either through the offline or online mode, involving electronic means, telescoping, direct selling or multi level marketing.

it is a highly progressive piece of social welfare legislation. This is a unique law which directly pertains to consumers in the market placeand seeks to redress complaints arising therform

it’s provisions are very comprehensive. it provides effective safeguards to the consumers against various types of exploitation and unfair trade practices.
why is special consumer court set-up?
the act has created special consumer courts for enforcement of the rights of consumers

this act covers both goods and services rendered for consideration by any person or organisation including public sector undertakings and all mode of transactions
why is time frame given for the redressal of the complaint?
the act lays down time limits for the disposal of cases so as to provide speedy redressal of greivances.
what is consumer protection council?
to organise consumers and to educate them, the act also provides for the formation of consumers protection councils in every state. these councils do not have any legal authority under the Act. they are meant to promote the cause of the consumer protection and to protection rights.

Establishment of central Consumer Protection Act?
the 2019 act proposes the establishment of a regulatory authority known as central consumer protection authority (CCPA) under section 10 of CPA 2019 with wide powers that aimed to protect, promote and enforce the rights of consumers relating to unfair trade practices and false or misleading advertisements
three-tier grievance redressal machinery?
the act provides a three-tier consumer grievance redressal machinery-District Forums and at the base, the State Commission at the middle level and the National Commission at the apex level. the redressal machinery is quasi-judical in nature.
right to safety
this is the right to be protected agaginst the marketing of goods which are hazordous to life and property. there are various risks involved in the consumption and use of products such as food, drugs, toys, electrical appliances etc.
example- gas cylinder, if not sealed properly, may cause injury to life or even death.
the consumers have the right to get protection against such risks. consumers must have assurance regarding the quality, reliability and performance. thery are so many common household items, now availabe for consumers that contain potentially harmful substances. ex- food additives, food colouring, pesticides etc.
right to be informed?
the consumer has the right to be informed about thr quality, quantity, potency, purity, standard and price of the goods. it is the responsiblity of the manufacturer and distributor to give complete information about
a)the product including it’s ingredients, date of manufacture ,etc.
b)the precautions if any, to be taken in the use and maintainance of the product
c)the side effects and risks in the use of the product
d)strength, durability, serviceabilty and the reuse value of the product, etc.
the right to be assured
the right to choose
the consumer should be assured access to a variety of goods at competitive prices. this means the selling should not use aggressive selling techniques to sell the product to the consumer. there should be freedom to choose from alternative products. this requires free competition in the market. if enough varietites of the products at competitive prices are available in the market, consumers have the opportunity to make a free choice
The Right to be Heard
the consumer has a right to register his satisfaction and get his complaint heard at appropriate forums. the right includes the right to make protest. the three rights (the right to safety, the right to be informed, the right to be assured) are meaningless without the right to be heard. therefore, grievances and claims of consumers must be heard and considered.
the right to seek redressal?
it means the right to get claims and complaints settled against manufacturers or sellers due to unfair trade practices and exploitation by them. consumer has been granted the right to redress if the performance, quality etc, of a product is unsatisfactory. the product must be repaired, replaced or taken back by the seller. the right to seek redressal will reduce post- purchase doubts and grievances of the consumers.
