Disability DIscrimiantion Act
Australia upholds The Disability Discrimination Act to a good extent but needs could use further refinement. The Disability Discrimination Act (1992) makes it unlawful to discriminate against a person because of their disability.
Protects
It also protects people from discrimination because they are accompanied by an assistant, interpreter, trained animal or use equipment like a wheelchair.
Sydney Olympics (2000)
During the 2000 Sydney Olympics, Graeme Maguire, a wheelchair user, attempted to attend the Sydney Olympics but faced significant accessibility issues.
Accessibility
This included a lack a suitable seating, obstructed view and limited bathroom and transport facilities.
HRC
The Human Right’s Commission ruled in Maguire’s favour and demonstrated how the Disability Act can be used to challenge systemic barriers in public facilities
Flawed
However, the Disability Act is flawed, and some claims get ignored or dismissed. An example of this is Sklavos v Australia College of Dermatologists year. Dr Sklavos alleged the college failed to provide reasonable adjustments for his disability.
Dismissed
The Federal Court dismissed his claim stating that the colleges actions weren’t directly motivated by his disability. It was criticized for weakening protections for people with disabilities.
Therefore
Therefore, it is evident that although Australia does have the Disability Discrimination Act, they are still far behind where they need to be.
