what is betrothal/engagement?
to pronounce an engagement or to solicit a marriage.

traditional muslim family: includes close relatives (esp uncles) who act as real fathers in terms of guardianship and discipline.
modern muslim family: consists of the mother, the father, and the children.

- patriarchal: the father is the chief of the household in terms of financial support
- mother: responsible for the internal affairs, budget planning, and surveillance. to report to the father when she cannot solve an issue.
- children: purpose the family was established. they are expected to respect their elders.

- a good muslim wife respects and loves her husband.
- she obeys him and does not argue with him all the time.
- the prophet said to avoid 3 types of women: one who complains, one who keeps talking about her favors to her husband, and one who is always homesick

- mahr: a bridal gift given to the bride and remains her property
- witnesses: two adult witnesses to validate the marriage

what is divorce
the desolution of a marriage contract
expressions of divorce
- explicit (i divorce you). no intention needed
- implicit (you are free): intention needed
types of divorce
- unilateral: husband initiates the divorce by saying i divorce you followed by a waiting period
- delegated: husband can delegate the right of divorce to his wife as part of marriage contract
- judicial: the wife can file for divorce in court on the ground that she is being subjected to harm and the judge acts on behalf of the wife to effect the divorce.

child custody
- custody is given to the mother until the age of 7-9 for a boy and 12 for a girl.
- mother’s eligibility depends on an ethics and trustworthiness, and the ability to protect the child’s health and living close to the father
- if mother is ineligible, custody is given to maternal grandmother then to parental grandmother
