When arranging an inspection I make sure I have a name and contact number of the person I am meeting, make sure my calendar is updated with the necessary information (time, date, location, mobile phone number, emergency contact, contact details of who I am meeting etc.), ensure I take the necessary PPE with me etc.

An asbestos register must be kept up to date and maintained by the duty holder (depending on the lease and repairing responsibilities this could be the leaseholder or the landlord).

What legislation governs asbestos?
The Control of Asbestos Regulations 2012 This is the key legislation which states a responsible person has a statutory duty to manage existing asbestos in commercial buildings. It is a criminal offence to fail to comply with the Regulations.

What are the requirements of a duty holder?
Duty holder has to prepare a plan that sets out in detail how the risks from these materials will be managed. Duty holder is the owner of the premises if vacant or a tenant if holding a repairing lease.

What are the 5 steps regarding the management of asbestos?
1) Duty holder to assess whether the premises contains asbestos and if so where it is and what condition it is in. If in doubt, materials must be presumed to contain asbestos. 2) Assess the risk and produce a plan to manage the asbestos- do any areas need to be encapsulated or removed? 3) Produce an asbestos register 4) Make the register available to all relevant parties who might disturb it 5) Review the register twice a year.

What are the two types of survey?
Management survey and Refurbishment/Demolition survey Management = to locate and assess it and advise on its management during normal occupation and use of the premises. No sampling of materials or analysis is undertaken. Can be undertaken by the duty holder or a surveyor. Refurbishment/demolition survey = required where the premises or part of needs upgrading, refurbishment or demolition. Samples of materials suspected of containing asbestos are taken and analysed. Recommendations are made regarding their management. Undertaken by a surveyor.

What are the CDM Regs 2015?
Construction (Design & Management) Regulations 2015 The aim is to improve the overall management and co-ordination of H&S at all stages of a construction project.

What are the key implications of the CDM regulations?
- There is more focus on clients to put in place arrangements to ensure health and safety. - Clients can no longer assign their legal responsibilities to agents. - There must be a declaration of how long contractors will be given to plan and prepare for construction work. - Clients are deemed to assume the role of the principal contractor for any period during which other appointments aren't made.
