What is the key primary legislation relating to health and safety at work in the UK?
Health and Safety at Work Act 1974
What does the HSWA 1974 require?
Employers to, as far as reasonably practicable, ensure employees’ health, safety and welfare at work
What does PPE stand for?
Personal Protective Equipment

What is the Occupiers Liability Act 1957?
Confirms that an occupier or a landlord in control of premises must take reasonable care to ensure the reasonable safety of visitors
What is the Occupiers Liability Act 1984?
This applies to trespassers rather than visitors.
This Act applies where the occupier or landlord in control of the premises is aware of a danger and has reasonable grounds to believe that a trespasser may come into the vicinity of this danger.
What is asbestos?
A naturally occurring hazardous material and harmful to health. If disturbed, fibres are released into the atmosphere which if inhaled, can lead to asbestosis, a form of cancer.

What measures do you take to ensure your own health and safety on inspection?
When arranging an inspection I make sure I have a name and contact number of the person I am meeting, make sure my calendar is updated with the necessary information (time, date, location, mobile phone number, emergency contact, contact details of who I am meeting etc.), ensure I take the necessary PPE with me etc.
What considerations do you need to make before inspecting a property in poor repair?
Consider whether the building is safe to enter, whether you have the correct PPE.
What would you need to do if you managed a property where asbestos has been identified?
You must manage the asbestos which has been identified either by removal or by leaving it in place and managing it by way of regular asbestos surveys.
An asbestos register must be kept up to date and maintained by the duty holder (depending on the lease and repairing responsibilities this could be the leaseholder or the landlord).
What does the HSWA 1974 Act cover?
- Duty to every employee to ensure, so far as reasonably practicable, the H&S and welfare at work of all employees
- Must report injuries and dangerous occurrences
- Must undertake, record and regularly review a risk assessment (The Management of H&S at Work Regulations 1999).
- Personal Protective Equipment at Work Regulations 1992 requires employers to provide appropriate PPE for their employees.
- Policed by the H&S Executive as a criminal offence with fines and or imprisonment.
What is a hazard?
Anything that could cause harm.
What is a risk?
The probability that someone will be harmed.
What does RIDDOR stand for?
Reporting of Injuries, Diseases and Dangerous Occurrences Regulations
Tell me about Reporting of Injuries, Diseases and Dangerous Occurrences Regulations 1995?
- The trigger date for reporting injuries is over 7 days incapacitation.
- Such an injury must be reported to HSE within 15 days from the date of the accident.
- All employers must keep a record of all injuries over 3 days.
- Accident book must be kept for a minimum of 3 years.
