How are Sick Leave credits granted?
Sick Leave credits are granted in accordance with provisions of the Collective Bargaining Agreement (CBA) Unit 5A State Police Association of Massachusetts and the Department’s Rules and Regulations.

The member shall call to cancel the remaining Sick Leave at least eight hours prior to the reporting start time of their next shift.

Members may leave only with authorization of their Commanding Officer and to obtain prescribed medical care.

Supervisors are responsible for monitoring Sick Leave and reviewing attendance records for signs of abuse.

What are some signs of Sick Leave abuse?
Signs include excessive use, patterns of use around days off, use on holidays, and use after overtime.

What actions can supervisors take if they suspect Sick Leave abuse?
Supervisors can notify the member using the SP 382 Abuse of Sick Leave form or the SP 383 Submission of Medical Evidence form.

Members who abuse Sick Leave may face administrative or disciplinary action and denial of Sick Leave.
ADM-47 Biased-based Policing
What is biased-based policing?
Any prohibited pattern or practice, including, but not
limited to, stopping, detaining, questioning, frisking, and searching by
police officers, that is based upon a generalized belief that a person of a
particular race, ethnicity, national origin, gender, or other characteristic,
status, or trait, is more likely to commit certain types of crimes.

What is a suspect specific incident?
An incident in which a member is lawfully attempting to detain, apprehend, or otherwise be on the lookout for one or more specific suspects who have been identified or described in part by national or ethnic origin, gender, race, religion, sexual orientation, immigration status, gender identity or expression, economic status, age, cultural group, or disability or any other protected characteristic.
ADM-47 Biased-based Policing
To prevent bias-based policing, the Department shall:
- Provide training programs to ensure that appropriate employees
receive training on bias-based policing practices, implicit bias, the
legal aspects and consequences of bias-based policing and implicit
bias, and the standards established by this policy;
Ensure that this policy is disseminated to all members, dispatchers
and appropriate civilian employees; - Continuously review and, where appropriate, revise all procedures
that involve the stop, detention, apprehension, or search of individuals to ensure that procedures are in compliance with the
provisions of the law and this policy; - Continuously review performance recognition and evaluation
systems, training curricula, policies, and customs of the Department
to determine if any practice encourages conduct that may support
or lead to bias-based policing; and - Work with the Executive Office of Public Safety and Security
(EOPSS) and the Registry of Motor Vehicles to educate the public
on what to expect when either stopped or detained by the State
Police, as well as what the officer’s expectations are during motor
vehicle stops or detainment, to ensure the safety of both officers
and the public.

Biased-based policing: The Division of Standards and Training shall:
Promote professionalism throughout the Department;
Ensure that all employees receive training on the prevention and
elimination of bias-based policing;
Assist supervisors in identifying and modifying potentially
problematic behavior;
Utilize appropriate citizen complaint procedures to document and
investigate allegations of bias-based policing;
Investigate referrals from the EOPSS; and
Conduct a documented annual administrative review of agency
practices including public concerns

ADM-46 - Sexual Activity in Public Places - “Public Place” definition?
: For the purposes of this policy only, a place where it is
known or reasonably should be known that members of the public may be
present and/or may be able to observe activity. An area may be open to the
public and not be considered a public place for the purposes of this policy if
a reasonable person would not foresee that his/her activity would be seen by
a member of the public

ADM-46 - Sexual Activity in Public Places - “Sexual Conduct” Definition?
For the purposes of this policy only, the exposure or
touching of the genitals, buttocks, or female breasts for purposes of sexual
arousal, gratification or offense, or public solicitation to engage in such
conduct in a public place. Sexual conduct does not include socializing and
expressions of affection absent the particularized conduct described in this
subsection.

MGL c. 272, § 16 Open and Gross Lewdness
To sustain a conviction for open and gross lewdness, the Commonwealth
must prove five (5) elements:
That the defendant exposed their genitals, buttocks, or female breasts to one or more persons;
That they did so** intentionally;
That they did so openly**, i.e., with the intent of exposing themselves, or in reckless disregard or substantial risk of public exposure, to others
who might be offended by such conduct;
That defendant’s act was done in such a way as to produce alarm or
shock; and
That one or more persons were in fact alarmed or shocked by
defendant’s exposing themselves. Members should identify at least one
witness, who is not a police officer, to satisfy this requirement.

MGL c. 272, § 35 Unnatural Acts
The conduct must:
Occur in a public place;
Involve oral contact with the genital or anal area, anal intercourse or
masturbation of another person, or any other intrusion of a part of one
person’s body or some other object into the genital or anal opening of
another persons’ body; and
Be done intentionally or with reckless disregard that others may observe
the conduct and be offended.
