What does the Sedimentation Pollution Control Act of 1973 apply to?
Sedimentation caused by erosion or depositing of soil from construction sites and road maintenance. Does not apply to agriculture, forestry, mining, or emergency activities.
When does sedimentation occur?
When flowing water slows down enough to allow suspended soil particles to settle.
What is required by 15A NCAC 04B.0108 for erosion control?
Erosion control measures shall be planned, designed, and constructed to provide protection from the run off of that 10 year storm.
When must erosion and sedimentation control plans be filed under 15A NCAC 04B.0118(a)?
At least 30 days prior to beginning such activity, with three copies filed with the local government or Commission.
What must erosion and sedimentation control plans include under 15A NCAC 04B.0118(c)?
An authorized statement of financial responsibility and ownership signed by the person financially responsible for the land-disturbing activity.
Who conducts inspections under 15A NCAC 04B.0120?
The staff of the Department of Environment, Health, and Natural Resources or other qualified persons authorized by them.
How is the width of a buffer zone measured under 15A NCAC 04B.0125(a)?
From the edge of the water to the nearest edge of the disturbed area, with 25% of the strip nearest the land-disturbing activity containing natural or artificial means of confining visible siltation.
What is the buffer zone requirement for trout waters under 15A NCAC 04B.0125(b)?
Minimum width of 25 feet from the top of the bank or enough width to confine visible siltation within the first 25% of the buffer zone, whichever is greater.
What are the requirements for diversion dikes for perimeter protection?
At least 2’ across at the top and 18” high.
What is the required capacity for sediment basins?
Designed with a storage capacity of 1800 cf/acre.
How deep must silt fence fabric be buried?
12 inches below grade.
