what does deterrence mean
discouraging an action or event through the usage of punishments/consequences
what does rehabilitation sentencing mean
focusing on helping offenders change their behaviour so they don’t re-offend
what does retribute mean
punishing the offenders (fairly) for their actions based on the belief that they deserve to be punished
what does protection sentencing mean
safeguarding the community from harm caused by an offender
what does denunciation mean
the court explicitly communicates that the offender’s behaviour is unacceptable and won’t be tolerated
what are mitigating factors
lessens responsibility
remorse, cooperation, rehab, first offence, guilty plea
what are aggravating factors
making sentence worse
prior offences, violence, lack of remorse
alternative sentences could be circle sentencing or restorative justice. what are those two things
circle sentencing- an alternative sentencing designed for Indigenous people who have offended or pleaded guilty (a group of individuals discuss the offence, the impact, and possible solutions)
restorative justice- a system that focuses on the rehabilitation of offenders through reconciling with the victims and community
what are the different sentence types and their examples
control order (strict supervision), community service order, youth justice conference (a meeting between offender and victim), good behaviour bond (formal promise to stay out of trouble for a set period), warning or caution (formal/informal police response to minor offences), probation order (regular check ins with youth justice officer), detention (custodial sentence where a young person is placed in prison)
