OBJECTIVES OF THE HPCSA:
- to co-ordinate the activities of the professional boards established in terms of the Act
- to promote and regulate interprofessional liaison between registered professions in the interest of the public
- to determine a strategic policy with regard to the professional boards and the registered professions
- to consult with the relevant authorities on matters affecting the professional boards in general
- to assist in the promotion of the health of the population of the Republic.
GENERAL POWERS OF THE HPCSA:
- may render financial assistance to professional boards in order to ensure that such boards perform their functions
- make rules on all matter which the council considers necessary
- delegate its powers to any committee or any such person.
- establish ad hoc disciplinary appeal committees, as the need arises.
DISCIPLINARY POWERS OF PROFESSIONAL BOARDS:
- a fine not exceeding R10 000
- a caution or reprimand and caution
- the payment of cost for the proceedings
- removal of his name from the registrar
- suspension
SECTION 27(1)(a):
Everyone has the right to access to health care services including reproductive health care.
EVERYONE: section 27(1)(a) does not contain any internal limitations
-it therefore includes any person within the territorial jurisdiction of South Africa
ACCESS TO: it is not a direct right per se.
-aimed at ensuring reasonable access to general health care services
-the user has a choice in exercising the right or not
HEALTH CARE SERVICES: has broad interpretation but aimed at sufficing basic socio-economic needs
-it should be preventative and reactionary in nature.
REPRODUCTIVE HEALTH CARE: includes contraception, conception, fertility, pre-natal, perinatal and post-natal care
-should be preventative and curative.
SECTION 27(2) read with section7(2):
Rationing means prioritising the most pressing health care concerns of an many people as possible.
ASPECTS:
1. reasonable legislative and other means
2. within its available resources
3. progressive realisation of rights
MINISTER OF HEALTH V TAC:
a holistic approach to health care services would be in keeping with the constitutionally imposed obligation to promote, protect, respect and fulfil the rights in the Bill of Rights.
