WHAT IS A “FOODSTUFF”?
a foodstuff is any article or substance, except a medicine as defined in the MRSA, ordinarily eaten or drunk by a person, or purporting to be suitable, or manufactured or sold, for human consumption, and includes any part or ingredient of any such article or substance.
MEDICINE AND FOODSTUFF:
medicines and foodstuff are therefore mutually exclusive
-a single product cannot qualify as both.
FACTORS TO CONSIDER IN A FOODSTUFF:
- description of the product
- claims made on the pack
- ingredients
- composition
- where the product is purchased
- the primary function or purpose of the product.
WHAT IS A “COSMETIC”?
a cosmetic is any article, preparation, or substance except a medicine as defined in the MRSA, intended to be rubbed, poured, sprinkled, or sprayed on or otherwise applied on the human body, including teeth, hair, lips and external genital organs, for purposing of cleansing, perfuming, correcting body odours or altering the appearance, including any part or ingredient of any such article or substance.
WHAT IS “DISINFECTANT”?
a disinfectant is any article or substance used or applied or intended to be used as a germicide, preservative, antiseptic or as a deodorant or cleansing material which is not a cosmetic.
WHAT IS AN ADVERTISEMENT OR ADVERTISE?
an advertisement or advertise in regard to any medicine, scheduled substance, medical device or IVD means:
any written, pictorial, or other descriptive matter, or verbal statement or reference:
-appearing on any newspaper, magazine, pamphlet, electronic media or other publication
-distributed to members of the public
-brought to the notice of members of the public in any manner whatsoever intended in the promotion of the sale of the medicine, scheduled substance, medical device or IVD.
Goods and services should not be marketed in a manner that is misleading, fraudulent or deceptive in any way, including in regard to:
- their nature, properties, advantages or uses
- the manner in, or conditions in which, those goods or services may be supplied
- the price at which the goods may be supplied
- any other material aspects of the goods or services
in terms of s42 of the General Regulations:
-Schedule 0 and 1 medicine may be advertised to the public and health care practitioners
-Medicine in schedule 2 and up may only be published to health care practitioners, in a publication normally or only made available to health care practitioners.
WHAT SHOULD AN ADVERT FOR A MEDICINE CONTAIN?
- the propriety name
- the approved name and quantity of each active ingredient of such medicine
- complementary medicine
