Article 403 Penal Code

A
  1. Anyone who practices acts proper to a profession without holding the corresponding academic degree
    issued or recognized in Spain in accordance with current legislation shall be liable to a fine of twelve to
    twenty-four months. If the professional activity carried out requires an official qualification that accredits
    the necessary qualification and legally enables it to be exercised, and the person does not hold such a
    qualification, the penalty shall be a fine of six to twelve months.
  2. A penalty of imprisonment of six months to two years shall be imposed if any of the following
    circumstances apply:
    a) If the guilty party, in addition, is publicly attributed the quality of professional protected by the title
    referred to.
    b) If the guilty party performs the acts referred to in the previous paragraph in a place or establishment
    open to the public in which the rendering of services proper to that profession is announced.
