what is nature and gravity of offence: mitigating facor
if the offending is on the low end of the scale of seriousness then this may persuade the court that the sentence is less than the max penalty imposed
remorse: mitigating factor
if the offender shows remorse the court is more likely to take this into account by showing that they apologised to victims and cooperted with the police
nature and gravity of offence: Aggrivating factor
doing an offending thats on the high end of the scale of seriousness which may lead to higher sentence
prior offending: aggrivating factor
if offender has engaged in previous criminal behaviour this may result in sentence being increased
