About Torts on Brainscape

What is Torts?

Torts is a branch of law often confused with Contract Law. There are, however, many differences. Firstly, people enter contracts with awareness in stark contrast to Tort Law. Additionally, Contract Law attempts to restore both parties to the previous position; Tort Law, conversely, will award an amount to the plaintiff to compensate them for loss and may also award punitive damages to punish the offender.

A Tort claim typically involves an intrusion by one party into the health, safety, privacy or finances of another. Some accuse Tort Law of fueling a “compensation culture” but it’s also credited with forcing much-needed regulation in the tobacco and automobile industries.

The best attorneys uncover every last detail of the case and armed with up-to-date rulings, argue convincingly (and if need be, emotively) to bring home the maximum compensation for their clients.
