Written Works, Online Posts, Movies and TV, Theatre and Dance, Art, Video Games, Political Yard Signs, Handing out Flyers, Symbolic Speech, Clothing, etc.
When should the court step in on free speech?
When it could lead to violence or inhibit the Government’s ability to it’s job, particularly at a time of war.
What is not protected under the first Amendment?
Blackmail, Defamation, Incitement of Imminent Lawless Action, Perjury, Plagarism, Solicitations to Commit Crime, Child porn, etc.
What does Freedom of Speech do?
Allows people to articulate opinions or ideas without interference from the government.
What must the Supreme Court do regarding Freedom of Speech?
They must always rule in favor of freedom of speech when possible, but try to balance social order and individual liberties as reflected in various interpretations.
What brings about different interpretations of freedom of speech?
Their involvement in time, place, or manner. How imminent they are to lawless action. Whether they are defamoratory, obscene, or offensive.
When limiting free speech, what is important to remember?
Limitations on freedom of speech SHOULD NOT suppress content of message and should only be placed to regulate accompanying conduct or reactions.
