Who will engage and pay the consultants?

A

Will depend on client - govt/mining companies will often require arch to engage directly
Preferable to have client engage as arch becomes more liable for consultant errors if they are engaged directly
Beware limitation of liability clauses - ensure consistent with yours
Ensure PI insurance covers risk

A

Arch engages, arch pays direct and bills client as lump sum
Arch engages on behalf of client, client reimburses arch for fees
Client engages and pays consultants on advice of architect
Client engages and pays consultants directly

When will consultants be appointed?

A

Early stage consultants: cost consultant, surveyor, geotechnical, planner, certifier (as necessary)
Other consultants: depends on size/difficulty of project. If any tricky conditions or requirements, may need expert advice early in project. Less unknowns - can design with full advice from experts and resolve earlier
Otherwise, typically engage after SD. Cheaper for client but run risk of unexpected costs due to unknowns

What are some considerations when selecting consultants?

A

Client will often ask Arch for recommendations - can theoretically be liable for poor consultant choice but likely to jeopardise project if refuse to cooperate!
Ensure consultant choices have enough capacity & expertise to handle project
If client selects consultant you do not want to work with: advise client of this (but don’t slander), if necessary advise in writing that issues may occur. In the end up to client discretion.
